You can report cigarette sales in unauthorized locations, either unlicensed stores or on the street. You can also report cigarette sellers who may have avoided City and State taxes by importing cigarettes from other states or countries.

Cigarette vending machines are allowed only in taverns that have a tobacco retail dealer license.

A tavern is a business where:

  • The primary purpose is to serve alcoholic drinks to be consumed on site
  • Food service is incidental or secondary to the sale of alcoholic beverages

Businesses like restaurants, bowling alleys, or theaters would not be allowed to have these machines.

You can make a complaint about a cigarette vending machine.

Cigarette vending machines can't be placed:

  • In a prohibited location
  • Where employees can't see it
  • Within 25 feet of the building's entrance

A sign must also be posted next to the vending machine that shows:

  • License number and expiration date
  • Address and phone number of supplier
