The Smoke Free Air Act (SFAA) protects the health of New Yorkers against the harmful effects of secondhand smoke by banning smoking and the use of e-cigarettes in public spaces.

Public spaces include:

  • Businesses
  • Child or day care centers
  • Convention halls
  • Gym, health clubs, and other membership associations
  • Health care facilities
  • Libraries
  • Museums and galleries
  • Office buildings, factories, and warehouses
  • Parks
  • Public and private schools
  • Restaurants and bars (including outdoor dining areas)
  • Residential building common areas
  • Shopping malls and retail stores (other than retail tobacco stores)
  • Sports and recreational arenas
  • Theaters, concert halls, and auditoriums
  • Zoos

You can report:

  • Ashtray in a smoke free area
  • Smoking or vaping signage missing or inadequate
  • Workplace policy not provided or inadequate

You can report an ashtray in a smoke free area at a location covered by the SFAA.

Business operators and residential property managers must post smoking or vaping signage at their establishment or in common areas of residential buildings. You can report smokng or vaping signage that is not posted or easily visible.

Business owners and employers are required to create a smoking and e-cigarette use policy. It should be posted for all employees and shared with new hires. In most cases, the policy should prohibit any smoking and e-cigarette use in indoor workplace spaces.
